Reason of Implementation of IMDT Act:-
There was a massive
agitation against foreigners in Assam after it Assam had faced a massive
infiltration from Bangladesh. The Government of India and All Assam Students
Union signed the Assam Accord to stop the movement. Eventually, the Illegal
Migrants (Determination by Tribunal) Act, 1983 (IMDT Act) came into force to
find out trespassers and deport them. The Act is applicable to those
Bangladeshi intruders who settled in Assam on or after 25 March 1971.
IMDT at the Supreme Court:-
The present Chief Minister
of Assam went to the Supreme Court. On 12th July 2005, the court rejected the
Illegal Migrants (Determination by Tribunals) Act, 1983. It said "the
Bangladesh nationals who have illegally crossed the border and have trespassed
into Assam or are living in other parts of the country have no legal right of
any kind to remain in India and they are liable to be deported." The court
termed it as unconstitutional and termed Bangladeshi infiltration an
"external aggression".
Difference
between IMDT and Foreigners (1946):-
The complainant determines the
citizenship of a suspected intruder under the Illegal Migrants
